The mediator does not take sides or make decisions for you. Instead, they guide the conversation, help each person be heard, and support you both to reach practical agreements that suit your circumstances. Mediation can cover parenting arrangements, property and financial settlements, or both.

Initial individual appointments
Each party meets privately with Rebecca, online or in person, to discuss their situation, goals and concerns, and to confirm that mediation is suitable.

Mediation and Heads of Agreement
Rebecca guides you both through structured discussions towards agreement. If you reach agreement, she prepares a Heads of Agreement setting out what you’ve agreed, which each of you can then take to your own lawyer to be formalised.
Before you book
Rebecca is an accredited mediator but cannot issue section 60I certificates. If you intend to apply to the court for parenting orders, you will generally need a certificate from a registered Family Dispute Resolution Practitioner first, unless an exception applies. If you’re unsure whether this affects you, please raise it when you enquire.
To protect the mediator’s impartiality, Hamilton Thomas Lawyers cannot act for either party in the matter once mediation has taken place. We encourage each of you to get independent legal advice from your own lawyer before, during or after mediation.

Yes. Our online mediation is available anywhere in Australia, so it doesn’t matter where you or your former partner live. All you need is a private space, a reliable internet connection and a device with a camera and microphone.
For many families, yes. Online mediation follows the same structured process, and many people find it easier to speak openly from a familiar, comfortable space. It can also lower the tension of being in the same room, and shuttle mediation works online too, with each of you in a separate virtual room.
The mediator explains the process, sets ground rules and gives each person the chance to share their perspective. You then work through the issues one at a time, exploring options until you reach agreement on as much as possible.
Yes. Mediation is a confidential process, and discussions are generally kept private, with limited exceptions such as where there are concerns about safety or the wellbeing of a child.
Yes. Shuttle mediation lets each of you stay in a separate room or online space while the mediator moves between you, which can reduce conflict and make the process feel safer.
You may be able to bring a trusted family member, friend or professional support person, subject to prior discussion and approval. Rebecca will talk through their role with all participants beforehand so the session stays balanced and focused.
Not necessarily. Many couples mediate without lawyers present, but getting legal advice before signing any agreement is strongly recommended. Where both parties agree, legally assisted mediation lets each of you have your own lawyer involved on the day.
No. Because Rebecca acts as an impartial mediator, the firm cannot represent either party in the matter afterwards. Each party should obtain advice from their own independent lawyer.
No. If you need a section 60I certificate to apply for parenting orders, you will need to attend family dispute resolution with a registered Family Dispute Resolution Practitioner.
Agreements reached at mediation are not automatically legally binding. If you reach agreement, Rebecca prepares a Heads of Agreement setting out what you’ve agreed. Each of you can then get independent legal advice and have the agreement formalised through consent orders or a binding financial agreement.
